Exact Replacement Part Warranty

Exact Replacement Part Warranty

Warranty Coverage

ERP provides a one-year limited warranty on eligible products, beginning on the date of installation or sale by an authorized distributor. This warranty covers defects in materials, workmanship, or operation under ordinary conditions appropriate to the installation.

When ERP determines that a product was defective within the applicable warranty period, ERP’s obligation is limited to repairing it, replacing it, or issuing credit, at ERP’s sole discretion. Repairs and replacements remain covered only for the unexpired portion of the original warranty.

Electronic parts are excluded from this warranty and cannot be returned.

Exclusions

Warranty coverage does not apply to glass, ceramic, or plastic items; products that ERP reasonably determines, following inspection, show improper installation or application, misuse, tampering, burned contacts, stripped threads, or damage from water or fire; or oven, furnace, or dryer igniters damaged during shipping when that damage is not reported to ERP within 15 days of receipt.

ERP does not provide coverage for installation-related damage, labor, or products used improperly.

Submitting a Warranty Claim

Direct warranty claims to ERP’s Customer Service Department. Each claim must include the ERP part number; evidence of the installation date or sale date from an authorized distributor; date the product failed; make and model of the equipment in which it was installed; a detailed description of the failure; the service company’s name, address, and telephone number; the equipment owner’s name, address, and telephone number; and the purchase invoice date and corresponding purchase order or invoice number.

ERP will not process a claim without the applicable purchase order or invoice number.

After receiving the required information, ERP will supply a warranty return authorization packing slip, which must accompany the shipment. The buyer must return the products to ERP for inspection with shipping prepaid.

Attach a warranty tag to every item and include a list identifying each part number, quantity, and corresponding purchase order or invoice number. Also provide the name, telephone number, and email address of the person who should receive the return authorization.

Returns and Credits

Before returning merchandise, obtain ERP’s written approval and a Returned Goods Authorization (RGA) number. Authorized returns must reach ERP within one calendar year of purchase.

Returned merchandise must be unopened, unused, in good working condition, and securely packaged to prevent shipping damage. Clearly display the RGA number on the shipment.

ERP may deny or reduce credit when returned merchandise has been opened, damaged, compromised, or otherwise differs from its original shipped condition, whether new, refurbished, or unused, as applicable.

Any credit is limited to the amount paid for the merchandise, minus any applicable restocking fee. Shipping, transportation, and insurance expenses, including return shipment costs, remain the buyer’s responsibility.

For merchandise returned without a valid RGA number, ERP may choose to issue credit less a 20% restocking charge or dispose of the merchandise without issuing credit.

ERP also reserves the right to discard merchandise that was not originally purchased from ERP. The buyer has 30 days to pay the applicable shipping and handling fee; otherwise, ERP may dispose of the merchandise without further recourse for the buyer.

Inspection and Order Discrepancies

Inspect all products and services upon receipt. Report nonconforming products, defective merchandise, freight damage, shortages, pricing errors, or incorrect parts within 15 days of delivery.

If a product does not meet the written specifications accepted by ERP, notify ERP before returning it. Include the purchase order number, ERP invoice number, the number and condition of cartons received, and any other information that may help identify the cause.

ERP may elect to repair or replace returned nonconforming merchandise or refund or credit its purchase price.

For common-carrier shipments, ERP accepts no responsibility for damaged or missing cartons unless the carrier’s agent signs the delivery receipt with the discrepancy recorded. ERP will investigate shipping discrepancies and issue credit where appropriate. Buyers may not deduct disputed amounts from payments.

Warranty and Liability Limitations

Except for the warranty expressly provided in these terms, ERP disclaims all express and implied warranties concerning its products and services, including merchantability and fitness for a particular purpose. ERP accepts no liability for losses or damage attributed to warranties not expressly provided and permitted under these terms.

Whether a claim is based on breach of contract, breach of warranty, negligence, or strict liability, ERP’s responsibility is limited to repairing or replacing parts ERP finds defective or, at ERP’s option, issuing credit for their purchase price.

ERP will not be liable for incidental, consequential, exemplary, or punitive damages connected with its products, services, or obligations. These excluded damages include loss of use, income, or profit; losses caused by delay; personal injury or death; and property loss or damage, including property handled or processed using the products.

The buyer must indemnify ERP against liabilities, costs, and expenses arising from such losses, damage, or injuries caused by or related to the buyer’s actions.

Shipping Risk

Unless otherwise agreed, responsibility for loss passes to the buyer when the products are delivered to the carrier at ERP’s facility. The buyer also bears the risk associated with products subsequently returned to ERP.

Agreement and Changes

Once ERP accepts an order, these terms constitute the entire agreement between ERP and the buyer. Other statements, correspondence, or terms do not change this agreement unless ERP approves the change in writing.

These conditions govern transactions even when ERP uses the buyer’s purchase order number as an accommodation. ERP’s waiver of one breach does not waive another breach of the same provision or any other provision.

Order changes require ERP’s written approval. If an approved change increases performance costs or the time required to complete the order, an equitable adjustment will be made and documented in writing.

Applicable Law and Disputes

Illinois law governs disputes involving these terms, the relationship between ERP and the buyer, and purchases of products or services, without applying conflict-of-laws rules.

ERP and the buyer agree that all related proceedings must take place exclusively in state or federal courts located in Cook County, Illinois, United States, and consent to those courts’ jurisdiction.

If a provision is prohibited by law, it will be ineffective only to the extent prohibited. The remaining provisions will continue in effect.

Suspension, Termination, and Updates

ERP may restrict, suspend, or discontinue supplying products if the buyer violates these terms, creates legal liability for ERP, or disrupts ERP’s business.

ERP may revise these conditions and will provide the buyer with at least 30 days’ notice before changes become effective.
